Mariana Hardwick Wholesale Account Agreement
By creating a wholesale account and placing orders through the Mariana Hardwick Wholesale Portal, you acknowledge and agree to the following terms and conditions.
1. Orders
All orders must be submitted through the Wholesale Portal and completed in full. Orders are considered received and accepted only upon issuance of a Sales Confirmation by Mariana Hardwick.
Standard production lead time is approximately 18–20 weeks from order confirmation. This timeframe refers to completion of production and does not include quality control, processing, or shipping, which may require up to an additional four weeks. Customisations, fabric changes, and special requests may extend lead times and are subject to approval.
Each order must include accurate style, colour, size, measurements, purchase order number, and required delivery date. Orders with incomplete or incorrect information cannot be processed.
Rush orders are subject to approval based on production capacity and fabric availability and incur surcharges
2. Payment Terms
A 50% deposit is required within seven (7) days of Sales Confirmation. The remaining balance must be paid in full prior to dispatch.
Payments may be made via bank transfer or credit card. Applicable processing fees may apply.
3. Returns & Claims
As all gowns are made to order, returns or refunds are not accepted unless a manufacturing fault is identified.
All garments undergo comprehensive quality control prior to shipment. Any claim must be submitted through the Wholesale Portal within seven (7) days of receipt and include photographic evidence, including the garment swing tag and order identification.
4. Retention of Title
Ownership of all goods remains with Mariana Hardwick Pty Ltd until payment has been received in full.
5. Freight & Duties
Shipping charges are applied per order and will be invoiced accordingly. Express shipping surcharges may apply.
All shipments are supplied on a Delivered Duty Unpaid (DDU) basis. Freight charges cover delivery to the nominated business address; however, all local duties, taxes, customs charges, and import fees remain the responsibility of the stockist
6.Intellectual Property
All trademarks, designs, imagery, branding, and intellectual property associated with Mariana Hardwick remain the exclusive property of Mariana Hardwick Pty Ltd.
Stockists are granted a limited, non-exclusive licence to use approved brand assets solely for the promotion and sale of Mariana Hardwick products. Brand assets may not be reproduced, modified, sublicensed, or used for any third party without prior written consent.
7. Territory & Exclusivity
Mariana Hardwick is committed to supporting strong retail partnerships and maintaining brand integrity within each market.
To maintain exclusivity within an agreed territory, stockists are expected to carry and regularly refresh current collections and maintain sales performance consistent with the size and potential of their market. Should sales performance fall significantly below expectations over a sustained period, Mariana Hardwick reserves the right to review territorial exclusivity and appoint additional stockists where appropriate.
Goods may not be transferred between stores or locations that are not an approved stockist.
8. Acceptance
By creating a wholesale account, you confirm that you have read, understood, and agree to be bound by these terms and conditions.
